1. Acceptance of Privacy Policy

The North Philadelphia Seventh-day Adventist Church (“THE NORTH CHURCH,” “we,” “us” or “our”) respects your privacy. This privacy policy (“Privacy Policy”) explains what information we collect from users of THE NORTH CHURCH’s websites, applications (e.g., mobile apps, tablet apps) or other interactive services (collectively, all such websites, applications and other interactive services are individually and jointly referred to as “Site”). If you choose to visit or utilize any Site, such is subject to this Privacy Policy and our Terms & Conditions(“Terms”) [Terms: http://thenorthchurch.is/terms- conditions/]. Capitalized terms that are not defined in this Privacy Policy shall use the same definition as provided in the Terms. THE NORTH CHURCH reserves the right to amend the Privacy Policy from time to time without notice and at our discretion. It is your responsibility to review the Privacy Policy for updates periodically, which shall be effective once posted. If any changes are material and/or retroactive, we may provide additional notice and/or an opportunity to “opt-in,” as appropriate under the circumstances, such as positing the same on our Site.

YOUR CONTINUED USE OF THE SITE OR ANY FEATURES, ACTIVITIES OR SERVICES OFFERED THROUGH THE SITE, WILL BE DEEMED ACCEPTANCE OF THE PRIVACY POLICY AND THE TERMS.

2. When This Privacy Policy Applies

This Privacy Policy applies: regardless of whether you are accessing the Site via a personal computer, a mobile device or any other technology or devices now known or hereafter developed or discovered (each, a “Device”); whether you are accessing the Site as a registered user (if offered by the Site) or other user of the Site; to all User Information (as that term is defined in the Terms) collected by the Site (as defined above), but does not, unless specifically stated, apply to any information collected by any third party; will remain in full force and effect even if your use of or participation in the Site or any particular service, feature, function or promotional activity offered through the Site terminates, expires, ceases, is suspended or deactivated for any reason.

3. Jurisdiction

The Site is designed and targeted to individuals in the United States of America (“U.S.”) and is governed by and operated in accordance with the laws of the U.S. We make no representation that this Site is operated in accordance with the laws or regulations of, or governed by, other nations. If you are located outside of the U.S. you use this Site at your own risk and initiative and you, not us, are responsible for compliance with any applicable local and national laws. Please be aware that any User Information you provide to us or other information we obtain as a result of your use of this Site shall be collected in the U.S. and/or transferred to the U.S. and subject to U.S. law. By using this Site, participating in any Site activities and/or providing us with your User Information, you (a) consent to the transfer and/or processing of any Information to and in the U.S., (b) acknowledge that U.S. law may provide a lower standard of protection for personal data than the laws of your location and (c) understand that we shall collect, transfer, store, process and/or deal with your Information in accordance with this Privacy Policy and U.S. law. Consequently, to the full extent permitted by law, you hereby waive any claims relating to the processing of your User Information or other information in accordance with this Privacy Policy that may arise under the laws and regulations that apply to you in or of any other country or jurisdiction.

Transfers outside the European Economic Area (“EEA”)

The information described in this section of the Privacy Policy, with respect to the transfer of data outside the EEA, applies to those individuals located in the EEA. To process information of individuals located in the EEA for the purposes set out in this Privacy Policy, it is sometimes necessary for us to share your personal data outside the EEA, for example:

with service providers located outside the EEA;
if you are based outside the EEA;

where we consider that the transfer is necessary for exercising, establishing or defending legal rights including, as appropriate, providing information to respond to a government, law enforcement, judicial or other legal request, or otherwise to comply with applicable law.

Non-EEA countries might not have the same legal framework for data protection as the EEA countries. In particular, the United States, which is the most common destination of our transfers of Personal Information outside the EEA, is not considered to provide a level of personal data protection equivalent to that of the EEA. We will, however, ensure the transfers comply with EU data protection law. 4. Information We Collect

You may have the option to share your personal information on our Site when registering for services, communicating with us and/or communicating with others. Following is a summary of the information we collect during such interactions with the Site:

(a)  Site Registration. When accessing some areas of the Site, registration may be required before certain content and features can be accessed. Our registration forms may request your contact information (such as your name, email address, mailing address, etc.), demographic information (such as your country, gender, etc.), profile data (such as your listening/viewing preferences, etc.) and User Information (as defined in the Terms). You may be assigned a site username and/or password. For our internal purposes, we use this information to communicate with you and provide the services you have requested, and to provide a more personalized experience on our Site. By visiting our Site, you affirmatively consent to our collection and use of your data.

(b)  Communications from Us. Registered users of the Site may receive newsletters, email communications, or communications through other channels for, among other purposes, the promotion and marketing of a product or service from THE NORTH CHURCH, and we may also offer other visitors to our Site the opportunity to sign up to receive such information. When there is a separate sign-up for newsletters, we ask for contact information such as name and email address, and, sometimes, demographic and profile information. By visiting our Site you affirmatively consent to our collection and use of your data. We use this information in the same manner as we use the contact information in the registration process described above. We may offer our users the choice whether to receive mailings from others that we think will be of interest. Recipients of our mailings can unsubscribe by following instructions that may appear at the end of email communications. Note that in order to keep our registered users informed about the operation of our services, we may send emails and announcements that are needed for the proper functioning and administration of our Site and service.

(c)  Communications with Us. THE NORTH CHURCH may have or implement features where you can submit information to us (such as when contacting us with a question or feedback). We may retain your emails and other information you submit to us for our internal purposes, and to help us to serve you better.

(d)  Communications with Others. THE NORTH CHURCH may offer features where you can send information to others. We will use the contact information you enter to send the information requested.

(e)  Contests, Sweepstakes and Surveys. THE NORTH CHURCH may also have Promotions, such as contests, sweepstakes and surveys at our Site. When you enter or participate in them, we request contact information from you (such as your full name, email address, mailing address, and telephone number) and may also request demographic or profile information. We will use the information you provide for the purpose of conducting the Promotion (for example, to contact you if you have won). We may also use the information to send you newsletters and other information we think may be of interest. Recipients of our mailings can unsubscribe by following instructions that may appear at the end of the email communication. Any personal information we collect may be associated with registration information. We may share aggregate information with others. We may sometimes partner with sponsors in offering Promotions and may share (provide and receive) information with them. By entering or participating in such Promotions, you affirmatively consent to our collection and use of your data.

(f)  Accuracy. It is your responsibility to give us current, complete, truthful and accurate information, including User Information, and to keep such information up to date. We cannot and will not be responsible for any problems or liability that may arise if you do not give us accurate, truthful or complete information or User Information or you fail to update such information or User Information. We will reject and delete any entry that we believe in good faith to be false, fraudulent or inconsistent with this Privacy Policy. 

5. Automatic Data Collection – Use of Cookies

THE NORTH CHURCH Site may have features that automatically collect information from users to assist us in creating a Site that honors our users’ preferences and serves their interests and needs. Portions of the Site use “cookies”, which are small data files containing information about the user that are stored on the user’s hard drive. Some cookies are used to make login to our sites easier (such as by remembering usernames and passwords). Cookies can also enable us to track users’ movements and target their interests to enhance their experience on our Site. We use this information for our internal security audit log, trend analysis, and system administration, and to gather broad demographic information about our user base. We may associate this information with your personal information. By visiting our sites, you affirmatively consent to our collection, use, and distribution of your data.

6. Disclosure of Information

THE NORTH CHURCH does not sell or lease the information you provide to third parties. THE NORTH CHURCH, however, does use other companies, agents, or contractors to perform services on our behalf. For example, THE NORTH CHURCH has partnered with third party companies, to provide infrastructure and IT services, personalize and optimize our application, process credit card transactions, provide customer service, collect debts, analyze and enhance data, including user’s interaction with our website, and process consumer surveys. In the course of providing such services, these third party companies may have access to your information. We do not authorize these companies to use or disclose your personal information except for the purpose of providing the services we request of them. By visiting the Site you affirmatively consent to our collection, use and distribution of your information.

THE NORTH CHURCH may use the information you provide to: (a) process orders, requests and payments, and to communicate with you about your accounts or any requests, orders, or payments; (b) provide requested services to our customers; (c) respond to any inquiries submitted to us and to provide technical support to customers and Site visitors; (d) adapt the content and information that we may provide to Site visitors to personalize experiences at the Site; (e) better understand how users access and use our Site and services; and (f) detect violations of applicable policies.

Other than as set forth in this Privacy Policy, we do not share your information with third parties, apart from those acting as our agents in providing our Site to you, and which agree to use it only for that purpose and to keep the information secure and confidential. Also, please be aware that in connection with any reorganization, restructuring, merger or sale, or other transferring of assets we reserve the right to transfer information, including personal information, provided that the receiving party agrees to respect your personal information in a manner that is consistent with our Privacy Policy. We will also disclose information we maintain when required to do so by law, for example, in response to a court order or a subpoena or other legal obligation, in response to a law enforcement agency’s request, or in special cases when we have reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) our rights or property. You should also be aware that courts of equity, such as U.S. Bankruptcy Courts, may have the authority under certain circumstances to permit your information to be shared or transferred to third parties without your permission.

THE NORTH CHURCH may share (provide and receive) aggregate information, which is not personally identifiable, with others. This information may include demographic data such as the gender and/or geographic location of groups of users, but it will not include personal information (such as your name or email address). We use aggregate demographic information about our audience in order to improve our service, for research purposes, marketing/promotional purposes and/or for industry reporting purposes, among others.

7. Data Collection from Children/Minors

THE NORTH CHURCH strives to comply with the Children’s Online Privacy Protection Act (COPPA). We do not knowingly collect personal information from U.S. children under 13 without appropriate parental notice and consent. We are committed to protecting children’s privacy. 8. Security

While the Internet and data transmission over the Internet is not 100% secure from intrusion, we maintain commercially reasonable physical, electronic and procedural safeguards to protect your User Information. However, regardless of our efforts and the Device you use to access the Site, it is possible that third parties may unlawfully intercept or access transmissions, private communications or other personally identifiable information.

“Phishing” is a real security risk on the Internet today. This involves a third party who attempts to steal a user’s personally identifiable information and/or financial account credentials through “spoofed” emails (e.g., emails that appear to come from THE NORTH CHURCH) that lead consumers to a non-THE NORTH CHURCH website, or otherwise respond in a manner that is designed to trick recipients into divulging Information such as credit card numbers, account usernames, passwords and social security numbers. THE NORTH CHURCH DOES NOT SEND EMAILS ASKING YOU TO PROVIDE OR CONFIRM CREDIT CARD NUMBERS, SOCIAL SECURITY NUMBERS OR YOUR USERNAME OR PASSWORD! If you receive such email communication, please forward it immediately to the Site’s Privacy Administrator at info@thenorthchurch.is, and then immediately delete the fraudulent email from your computer.

9. Merchant/E-Commerce Areas

Areas of THE NORTH CHURCH Site, such as the Site Store, have merchant/e-commerce areas, where users can purchase goods and services. Those areas may be facilitated by a third party e-commerce vendor that we have engaged. Personal information (excluding credit card or other financial information) collected by such vendors is shared with THE NORTH CHURCH and is subject to this Privacy Policy.

THE NORTH CHURCH Site may link to other sites and/or applications that may be of interest to you but are not under our control. These links do not imply endorsement by THE NORTH CHURCH, and we are not responsible for the availability of or the content contained in any linked site and/or application. If any third party site or application you interact with obtains or collects any personally identifiable information from you, in no event shall we assume or have any responsibility or liability. Accordingly, THE NORTH CHURCH encourages you to be aware when you leave the Site and to read the terms and conditions and privacy policy of each other website that you visit or application that you engage with.
